REGULAR MEETING, TOWN OF MARSHALL MARCH 11, 2014

The regular meeting of the Town Board of the Town of Marshall, County of Oneida, and the State of New York was held at the Town Hall, 2651 State Rte. 12B, Deansboro, NY on the 11th day of March, 2014.

Supervisor Sturdevant called the meeting to order at 7 P.M. 

 

RESOLUTION #  26

MINUTES

On a motion by Councilwoman McConnell, seconded by Councilman Buschmann, the following resolution was ADOPTED

             Ayes      3              Buschmann, McConnell, Schachtler

             Nays      0

RESOLVED that the Town Board accept the minutes of the regular meeting of February 11, 2014.

            Salt barn bids - opened and read by Matt Fuller, Barton & Loguidice: (all have a 5% bid bond)

RECOGNITION OF GUESTS:  

            David Georgius spoke regarding the Oneida Indian Land settlement. Agreement was given to Board members to read.

            Amy Doggett spoke about the Youth Recreation program.

 

 

DEPARTMENT REPORTS:

  • Zoning Board of Appeals:  David Georgius reported.

  •  Zoning/Building Codes Enforcement Officer: Report given to Board.

  •  Water Advisory Board: Report given to Board and Dan Yoxall reported.

  • Highway Superintendent: Superintendent Welch reported on

        • Sander was put on E-Bay with a reserve of $2,000

        • GPS are back from repair, will be put back in trucks

        • CHIPS meeting

        • Gradall needs new swing motor – approximately $8,500

        • Gutters on office – want to remove them before harm is done. Engineers will look at before they are removed.

        • Roof leak – engineer came out to check. March Associates has been called, they will follow through.

        • Green waste day will be the last Monday of the month instead of the last Thursday. Information will be put on website & in The Waterville Times.

        • Trash Days will by the first Thursday, Friday & Saturday in May.

        • 644 bucket – still pursuing.

    1. Town Clerk/Website Administrator:  Clerk Blunt gave the Supervisor one check.  The check was for $ 120.00 for clerk business.

    1. Supervisor's Report: Supervisor Sturdevant went over his report with the Town Board.

        • Town banking is now through NBT Bank.

        • SWOCO form to be signed

        • Judge Ingraham would like security on DA court nights, using Court budget

 

RESOLUTION # 27

 

On a motion by Councilman Schachtler, seconded by Councilman Buschmann, the following resolution was ADOPTED

                Ayes      4              Buschmann, McConnell, Schachtler, Williams

                Nays      0

RESOLVED that the Town Board give Judge Ingraham permission to interview for security for Court nights and to have the County come in for security inspection.

                                                                         

  • Supervisor attended meeting regarding Oneida land settlement. Another meeting will be held March 12.

  • Appoint a new ZBA Board member

 

RESOLUTION # 28

 

On a motion by Councilman Williams, seconded by Councilman Buschmann, the following resolution was ADOPTED            

    Ayes      4              Buschmann, McConnell, Schachtler, Williams

                                    Nays   0

RESOLVED that the Town Board accept the appointment of Robert Dangler as a ZBA Board Member.

 

 

j.  Committee Reports:

  • Parks and Recreation:  No report given.

  • SOCCOG:  Councilman Buschmann will attend meeting and report back.

 

 

RESOLUTION # 29

 

On a motion by Councilwoman McConnell, seconded by Councilman Schachtler, the following resolution was ADOPTED 

               Ayes      4              Buschmann, McConnell, Schachtler, Williams

   Nays      0

RESOLVED that the Town Board accept all reports as given.

 

 

 RESOLUTION # 30

 

On a motion by Councilman Williams, seconded by Councilman Buschmann, the following resolution was ADOPTED  

              Ayes      4              Buschmann, McConnell, Schachtler, Williams

   Nays      0

RESOLVED that the Town Board authorizes the Supervisor to pay the audited bills in the following

amounts:

            GENERAL         $  14,169.84

            HIGHWAY       $  20,775.84

            WATER            $   1,589.22

            FIRE                $  0

 

 

 

  OLD BUSINESS:

  1. Salt barn:  Bids received and read. Board will review.

  2. Timber sale: Survey being done.

  3. Insurance claim notice: Mr. Getman is pursuing. 

  4. 644 bucket: Mr. Getman is pursuing. 

 

 

NEW BUSINESS: none.

 

On a motion by Councilwoman McConnell and seconded by Councilman Buschmann, the Board went into executive session to discuss possible litigation at 8:45pm. Only Board members, Supervisor & Attorney were present.

 

On a motion by Councilman Williams and seconded by Councilman Buschmann, the Board came out of executive session at 9:30 pm.  Carried unanimously.

 

 

On a motion by Councilman Schachtler and seconded by Councilman Buschmann, the Board meeting was adjourned at 9:33pm. Carried unanimously.

 

 

 

 

 

 

 

 

RESOLUTION # 31

 

On a motion by Councilman Buschmann, seconded by Councilman Schachtler, the following resolution was ADOPTED  

              Ayes      4              Buschmann, McConnell, Schachtler, Williams

   Nays      0

RESOLVED that the Town Board permit Highway Superintendent Welch to buy truck from Carbone Auto Group.   (this was done over the phone on 3/12/14 per Supervisor Sturdevant)
