REGULAR TOWN BOARD MEETING TOWN OF MARSHALL            November 10, 2020

The Regular Town Board meeting for the Town of Marshall was held on November 10, 2020 at the Town Hall at 2651 State Route 12B, Deansboro, NY.

Present:          Jack Buschmann – Deputy Supervisor      Colleen Baldwin – Councilmember

                        Robert Blunt – Councilmember                Christian Steinmann – Councilmember (in at 7:05)

Robert Welch - Highway Superintendent

Mary Blunt - Town Clerk                         William Getman – Town Attorney

 

 

The meeting was called to order at 7:01pm by Jack Buschmann as Deputy Supervisor with the Pledge of Allegiance.

 

RESOLUTION # 64

On a motion by Councilmember Blunt, seconded by Councilmember Baldwin, the following resolution was

ADOPTED:       Ayes: 3  Baldwin, Blunt, Buschmann                Nays: 0

RESOLVED that the Town of Marshall accept the minutes of the Regular Town Board meeting of October 13, 2020.

 

RESOLUTION # 65

On a motion by Councilmember Blunt, seconded by Councilmember Baldwin, the following resolution was

ADOPTED:       Ayes: 3  Baldwin, Blunt, Buschmann                Nays: 0

RESOLVED that the Town of Marshall accept the minutes of the Special Town Board meeting of October 27, 2020.

 

RECOGNITION OF GUESTS:   Eric Schachtler asked again for the letter of engagement with Mr. Rossi. He asked if there isn’t such a letter, he would like something in writing stating that.

                                     

DEPARTMENT REPORTS:

o    Zoning Board of Appeals: Minutes in Board packet.

o    Assessors:  No report given

o    Zoning/Building Codes Enforcement Officer:  Report given to Supervisor

o    Water Advisory Board:  Report given to Supervisor.  Dan Yoxall was attending a source water protection webinar, so he couldn’t be at this meeting.

o     Highway Superintendent: Superintendent Welch discussed the following:

§  One Person Plowing training set for next Tuesday

§  Andrew Scoones starts next week to learn routes. Travis will be available part-time at night if needed.

§  Fire Dept has a new truck, may look into buying tanker

§  Eyesore near Frosts – he will check with Codes

§  Replacing road signs. County uses route numbers instead of street names

o    Town Clerk:  Town Clerk Blunt gave the Supervisor one check for $ 668.74 for clerk business.

§  Thoma requires the Town to have a Personnel Policy with Equal Opportunity language and  Section 504 Grievance Policy Procedure

 

RESOLUTION # 66 

On a motion by Councilmember Baldwin, seconded by Councilmember Steinmann, the following resolution was

ADOPTED:       Ayes: 4  Baldwin, Blunt, Buschmann, Steinmann           Nays: 0

RESOLVED that the Town Board adopt the Personnel Policy as written by Attorney Getman:

BE IT RESOLVED by the Town Board of the Town of Marshall, Oneida County, New York as follows: The Town of Marshall does not discriminate against qualified individuals with disabilities who, with or without reasonable accommodation, can perform the essential functions of the employment position that such individual holds or desires. It is the Town’s policy to hire, promote and maintain terms, conditions and privileges of employment in a manner which does not discriminate on the basis of a qualified individual’s disability.

The Town is an equal opportunity employer, and does not discriminate on the basis of race, color, sex, religion, age, national origin, marital status, disability, or veteran status. This policy applies to all terms and conditions of employment, including, but not limited to, hiring, placement, promotion, termination, layoff, transfer, leave of absence, compensation and training. Discrimination based in any of the above groups is strictly prohibited, and any of the above groups is strictly prohibited, and any employee who engages in such conduct is subject to appropriate disciplinary action in accordance with Civil Service Law Section 75.

Employees are encourages to bring any perceived violation of this policy to the attention of their department head or to the Town Supervisor immediately. If you are unable to discuss the matter with your department head or the Town Supervisor, take your complaint directly to the Town Board. All complaints of discrimination will be investigated discreetly and promptly, and your employment will not be affected by reporting such matters.

 

RESOLUTION #   67

On a motion by Councilmember Blunt, seconded by Councilmember Steinmann, the following resolution was

ADOPTED:       Ayes: 4  Baldwin, Blunt, Buschmann, Steinmann           Nays: 0

WHEREAS, Section 504 of the Rehabilitation Act of 1973 prohibits discrimination on the basis of disability in programs and activities conducted by the U.S. Department of Housing and Urban Development (HUD) or by grantees that receive financial assistance from HUD, and

WHEREAS, Part 8 of Title 24 of the Code of Federal Regulations (24 CFR) requires adoption of grievance procedures to address complaints of those who feel they may have been discriminated against on the basis of disability and also requires the provision of notice of said grievance procedures, and

WHEREAS, it is the policy of the Town of Marshall not to discriminate against any individual, person or group on the basis of disability and the intent of the Town to address any complaints that may arise pursuant to Section 504,

NOW, THEREFORE, BE IT RESOLVED that the Town of Marshall does hereby adopt by resolution internal grievance procedures (the “Procedure”) providing for the prompt and equitable resolution of complaints alleging any action prohibited by Section 504 of the Rehabilitation Act of 1973 of the U.S. Department of Health and Human Services regulations implementing the Act, and

                BE IT FURTHER RESOLVED, that the Town of Marshall does hereby designate the Town Supervisor as the Grievance Coordinator who shall be responsible for receiving and addressing complaints pursuant to the Procedure adopted hereby and attached hereto, and

                BE IT FINALLY RESOLVED, that the Town of Marshall will place its employees, the public, and potential beneficiaries of certain federal public programs on notice by undertaking certain actions that will include, but may not be limited to (1) providing a copy of the grievance procedure to its employees, (2) putting the public on notice by placing a notice in the Town’s  official newspaper subsequent to adoption of this Procedure, (3) placing copies of the Procedure in Town offices for review and dissemination, and (4) adding language to federal program brochures to insure all potential program beneficiaries are aware of the Town’s adopted grievance procedures.

§  Tree will be put up, with all new lights

§  Working on how to work the Santa visit

o    Economic Development: none

o    SWOCO: none

 

OLD BUSINESS:   A resident asked about the speed signs – not in the budget to buy now. May borrow some from another Town.

 

NEW BUSINESS: none

 

RESOLUTION # 68 

On a motion by Councilmember Baldwin, seconded by Councilmember Steinmann, the following resolution was

ADOPTED:       Ayes: 4  Baldwin, Blunt, Buschmann, Steinmann           Nays: 0

RESOLVED that the Town Board approve the 2021 Budget.

 

RESOLUTION #  69

On a motion by Councilmember Baldwin, seconded by Councilmember Steinmann, the following resolution was

ADOPTED:       Ayes: 4  Baldwin, Blunt, Buschmann, Steinmann           Nays: 0

RESOLVED that the Town Board authorizes the Supervisor to pay the audited bills in the following amounts:

GENERAL         $ 10,135.45     

HIGHWAY       $  9,416.90

WATER            $  1,005.27

 

 

 

RESOLUTION #  70

On a motion by Councilmember Baldwin, seconded by Councilmember Steinmann, the following resolution was

ADOPTED:       Ayes: 4  Baldwin, Blunt, Buschmann, Steinmann           Nays: 0

RESOLVED that the Town Board accept all reports as given.

 

RESOLUTION #  71

On a motion by Councilmember Baldwin, seconded by Councilmember Blunt, the following resolution was

ADOPTED:       Ayes: 4  Baldwin, Blunt, Buschmann, Steinmann           Nays: 0

RESOLVED that the Town Board go into Executive Session to discuss personnel at 7:40pm.

 

RESOLUTION #  72

On a motion by Councilmember Baldwin, seconded by Councilmember Steinmann, the following resolution was

ADOPTED:       Ayes: 4  Baldwin, Blunt, Buschmann, Steinmann           Nays: 0

RESOLVED that the Town Board come out of Executive Session at 8:09pm.

 

 

On a motion by Councilmember Baldwin, seconded by Councilmember Blunt, the meeting was adjourned at 8:09pm. Carried unanimously.
